Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your use of ostrall.com, a service operated by Jarta Labs LLC ("Ostrall", "we", "us", "our"). By using the site you agree to these Terms. If you do not agree, please do not use it.

2. What Ostrall is

Ostrall is a search and comparison tool. It helps you work out what a product is called, compares sellers, and links you to retailers. We do not sell anything. Any purchase you make is between you and the retailer, under their prices, shipping, returns, warranty and terms. Ostrall is not a party to that purchase and is not responsible for the retailer's products or service.

3. Prices and product information

Prices, availability, shipping costs, ratings and product details come from retailers and other third parties, or are sample data during the preview. They can be incomplete, out of date or wrong, and retailers can change them at any time. A "delivered price" is our estimate, not a quote. The price and terms shown at the retailer's checkout are the ones that apply. We do not guarantee that any listing is accurate, available, or the lowest price anywhere.

4. Rankings and suggestions

Ostrall ranks results and suggests products using our own methods, which we keep improving. A ranking or a label such as "best rated" or "cheapest" is an opinion based on the information we have. It is not a guarantee that a product suits your needs. You decide what to buy.

Sponsored listings. Retailers can pay to appear in a list labelled "Sponsored" under the search box while you type. Sponsored listings are advertising: they are always labelled, and paying never changes a product's or a seller's place in Ostrall's own results.

5. Links to other sites

Ostrall links to retailer and other third-party websites that we do not control. Their content, policies and practices are their own responsibility. Some links may in future earn us a commission; see our Affiliate Disclosure.

6. Acceptable use

Please use Ostrall as a normal shopper would. You agree not to:

• scrape, crawl or copy the site or its results by automated means, or use it to build a competing product;
• send automated or bulk searches, ratings or other traffic, or submit feedback meant to mislead our results;
• try to break, overload, probe or get around the site's security; or
• use the site for anything unlawful.

We may limit or block access that breaks these rules.

7. Optional accounts

You can use Ostrall without an account. If you choose to sign in with Google, your recent searches are saved so you can return to them on any device. You are responsible for activity on your own signed-in devices, so sign out on shared computers. You can clear your saved searches or delete your account at any time from the Ostrall home page. We may suspend or delete accounts that break these Terms, and we may discontinue accounts altogether, in which case saved searches will be deleted. Our Privacy Policy explains exactly what an account stores.

8. Your feedback

When you rate a result, pick a reason or send us a suggestion, you allow us to use that feedback to improve Ostrall, without payment or attribution. Our Privacy Policy explains what is recorded.

9. Intellectual property

The Ostrall name, logo, design and site content belong to Jarta Labs LLC. Product names, brands and trademarks belong to their owners and are used only to identify products. Showing them does not mean those owners endorse us or that we are affiliated with them.

10. Disclaimer

Ostrall is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not promise that the site will always be available or error-free.

11. Limitation of liability

To the fullest extent the law allows, Jarta Labs LLC and its owners and staff are not liable for any indirect, incidental, special or consequential damages, or for any loss arising from your use of Ostrall, from information shown on it, or from any purchase you make from a retailer. Ostrall is free to use, so our total liability for any claim is limited to US$50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Jarta Labs LLC from any claims, damages or expenses arising from your misuse of the site, your breach of these Terms, or your violation of any law or the rights of a third party.

13. Governing law

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Utah, unless applicable law provides otherwise.

14. Sponsored listings (for advertisers)

If you buy a sponsored listing on our Advertise page, these terms also apply:

• What you buy: for a flat fee per search term, your product can appear for 30 days in the "Sponsored" list shown under Ostrall's search box when a shopper types words matching that term. The list shows each product once, with every sponsoring retailer that sells it, ordered by total price including shipping. Every sponsor of a term pays the same fee.
• No guarantee of results: you pay for placement in the list for the period, not for views, clicks or sales. We show the views and clicks we count, but we don't promise any number of them.
• Automatic checks: we read the product page you give us (its name, price, shipping, image and availability) when you check out, after payment, and about once a day while the listing runs. Your page must be public, show a US-dollar price, match the search term, and not offer a product we don't advertise (including weapons and ammunition, tobacco and vaping products, drugs and products making medical claims, adult products, gambling, counterfeit goods, and cryptocurrency or financial products).
• Refunds: a term that fails the checks after you pay is refunded automatically. If your page later stops passing the checks (for example the product is removed or out of stock), the listing is switched off without a refund. Otherwise payments are non-refundable once the listing is live.
• Your content: you confirm you may sell the product and that what your page shows is accurate, and you let us display your product's name, price, image and link for the listing. We may remove any listing that breaks these terms or the law.
• Payment: payments are processed by Stripe, under Stripe's terms. We don't receive or store your card details.

15. Changes

We may update these Terms from time to time. The "Last updated" date above shows the current version, and continuing to use the site means you accept the updated Terms.
